Public and Products Liability

Cover, features and benefits

Protection against your legal liability for bodily injury to third parties and damage to their property, including obstruction, trespass, nuisance, interference, wrongful arrest and eviction.

Cover includes:

  • Contingent motor third party liability arising out of the use of vehicles not owned by you within the UK
  • Employees’ and visitors’ personal belongings
  • Personal liability of employees and directors whilst they are oversees on your business
  • Liability for loss of or damage to premises hired or rented to you for the purpose of your business
  • Legal costs and expenses in defending prosecutions under relevant health and safety legislation, Consumer Protection Act 1987 and Food Safety Act 1990
  • Court attendance costs

 

Exceptions and limitations

  • Cover for acts of terrorism is limited to £2,000,000 for any one event
  • Loss or damage to property in your custody of control or to products supplied
  • Liability arising out of products supplied in the knowledge that they could affect the navigation, propulsion or safety of any aircraft or other aerial device
  • Pollution or contamination
  • Work in or on or travel to or from or within products supplied to any offshore installation or support vessel
  • Liquidated damages, penalty clauses, fines or punitive damages
  • Terms will apply to the professional treatment cover, however this is dependent on the option taken and will be provided at quotation stage
  • Exposure to, inhalation of, fears of the consequences of exposure to/inhalation of, costs incurred in repairing, removing, replacing, recalling, rectifying, reinstating, or managing any property arising out of the presence of Asbestos.
  • The first £250 of each and every claim in respect of third party property damage and loss of or damage to premises hired or rented.

 

Property Damage

Cover, features and benefits

Accidental loss or damage to

  • Business equipment

Cover includes the temporary removal of property insured anywhere in Europe for up to 30 days anywhere in the world.

 

Exceptions and limitations

Please refer to Property Damage Section of Your policy

  • Wear and tear, gradual deterioration, faulty or defective design, materials or workmanship
  • Mechanical or electrical breakdown or derangement
  • Theft or attempted theft not involving entry or exit from buildings by forcible or violent means or from unattended vehicles if all doors and windows have not been locked
  • Vehicles must be left overnight in a locked building or secure in a fully enclosed yard.
  • Damage resulting from undergoing any process involving the application of heat
  • Damage to moveable property in the open by wind, rain, hail, sleet, snow, flood, dust
  • The first part of any claim (your excess).

 

Professional Indemnity

Cover, features and benefits

  • Civil Liability (civil liability includes but is not restricted to negligent act or omission, breach of duty, infringement of copyright, infringement of intellectual property rights, breach of confidentiality, defamation, dishonest or fraudulent acts or omissions) arising out of the conduct of the business. (Not applicable to claims arising from asbestos – see below)
  • Awards made by an ombudsman including the Ombudsman for Estate Agents
  • Awards made by an arbitrator including an arbitrator appointed under the Surveyors & Valuers Arbitration Scheme
  • Adjudicator awards made under the Housing Grants Act
  • Asbestos - Civil liability arising from negligent act or omission excluding claims arising from asbestos inspections (as defined by HSE) and bodily injury as per Royal Institute Chartered Surveyors minimum requirements £250,000 during any one period of insurance inclusive of and not in addition to the limit of indemnity Additional Clauses (Uin additionU to the limit of indemnity)
  • Fidelity (loss of insured’s own money or property through employee dishonesty) £250,000 in any one period of insurance
  • Documents (costs incurred to restore or reinstate lost or damaged documents under the insured’s control) £50,000 for any one occurrence limited to £200,000 in total in any one period of insurance
  • Estate Agents and Health & Safety Legislation legal costs (costs incurred in the defence of proceedings brought against the insured under certain statutory legislation such as Property Misdescriptions Act, Health and Safety at work Act, Estate Agents Act, Construction Design and Management Regulations £150,000
  • Other Costs (costs incurred in defending a claim)
  • Payment for Court attendance (compensation if attending court as a witness when defending a claim) Up to £300 per person per day subject to a total of £15,000 in any one period of insurance.
  • Representation Costs (costs incurred for representation at hearings and tribunals relating to matters that may become a claim under the policy) Up to £15,000 in any one period of insurance

 

Exceptions and limitations

  • Those civil liabilities not normally covered by a professional indemnity policy – Employers Liability, Public Liability, Products Liability, Property Owners, Directors and Officers, Motor, Marine, Aviation
  • Express warranties or guarantees; fines or penalties or any punitive or exemplary damages
  • Claims instituted or pursued in the USA or Canada; war & terrorism; date recognition; financial services; market fluctuations

 

Duration of policy

The policy will remain in force for 12 months from date of commencement, or as otherwise shown on your policy schedule.

 

Right of cancellation

If you are an individual/sole trader (including a partnership in England and Wales) buying a policy which provides cover for you in both a private and business capacity, you have the right to cancel your policy during a period of 14 days either from the day of purchase of the contract or the day on which you receive your policy documentation, whichever is the later. A full explanation of the cancellation rights can be found in the policy documentation.

In the first instance, please contact your insurance adviser or usual Norwich Union point of contact. Full details of our complaints procedure will be set out in your policy document.

We are covered by the Financial Ombudsman Service. If you have complained to us and we have been unable to resolve your complaint, you may then be entitled to refer it to this independent body. The Financial Ombudsman Service is available to individuals, certain small businesses, charities and trusts.

 

Financial Services Compensation Scheme

We are covered by the Financial Services Compensation Scheme (FSCS). If we cannot meet our obligations you may be entitled to compensation from the scheme, depending on the type of insurance and circumstances of any claim.
